The important stuff - Terms & Conditions

1. Acceptance of Terms

Please read the following terms and conditions carefully as they form the basis for the contract under which your booking will be accepted.

You acknowledge & warrant to Little Bird Travel (Registered as Directional Tourism) that you have accessed, read & accept these terms by making a booking with Little Bird Travel. 

Any references to Little Bird Travel “we’, “us’ and/or “our” in these Terms means Directional Tourism Limited Partnership trading as Little Bird Travel being your representative company. 

We, Directional Tourism Limited Partnership trading as Little Bird Travel (ABN 33 607 879 032), have packaged and presented tours, transfers and accommodation. In our opinion, we have provided information and pricing which is correct at the time of issue and also goods and services of merchantable quality. We do not own or operate services in our own right, acting only as booking agent for our service providers, and thus we are not responsible for these services. Bookings are subject to the terms, conditions and limitation of liabilities imposed by these service providers. We do not accept liability whatsoever for injury, damage, loss, delay, additional expenses caused directly or indirectly by events which are beyond our control and jurisdiction, including but not limited to war, civil disturbance, fire, floods, acts of God, acts of government or of any other authorities, accident to or failure of machinery or equipment or industrial action. It is important that you are satisfied that your travel consultant has fully and clearly explained to you what goods or services you are receiving.

To the extent permitted by law, we exclude all liability for any loss or damage whatsoever (including but not limited to physical and psychological injury, and loss or damage to property of whatever nature) arising out of or in any way connected with the offer or supply of goods or services by us or any third parties. If you believe that you did not receive what you requested and paid for, and you are requesting a refund, you must inform your travel consultant about the problem in writing as soon as possible after the problem has occurred. If the law implies a condition or warranty that cannot be excluded, our liability will be limited to the re-supply or the payment of the cost of re-supplying the relevant goods or services.

Directional Tourism trading as Little Bird Travel is ATAS accredited and a member of the Australian Federation of Travel Agents (AFTA) and Independent Travel Group (ITG).

2. Price & Currency

All prices quoted by Directional Tourism are in Australian Dollars unless specified at the time of quoting. Where conversion to another currency is necessary, it will be at a rate of exchange advised by your booking agent.

GST is included in all prices quoted in Directional Tourism brochures & online, unless specified otherwise.

All prices are subject to currency fluctuations. Directional Tourism reserves the right to amend without notice any prices in Directional Tourism brochures & online.

Any price changes applicable to your booking will be promptly notified to you by Directional Tourism. The price of your tour or other travel arrangements shall not change after the date on which payment has been made in full by you in relation to your booking.

 

 

 

3. Directional Tourism Reservation Deposits

Independent Travel & Self-Drive: except as otherwise specified in these Terms: In addition to deposits required by tour operator/airline or other travel supplier. A deposit of AU$150 per person is payable to Little Bird Travel (Registered to Directional Tourism) to secure the booking.

GROUP TOURS, SPECIALIST ACTIVITIES & SPECIAL EVENTS: In addition to deposits required by tour operator/airline or other travel supplier. A deposit of AU$150 per person or AUD$1,000 for the group (whichever is the lesser total amount) is payable to Little Bird Travel (Registered to Directional Tourism) to secure the booking

The deposit is payable at the time the reservation is confirmed by Little Bird Travel (Registered to Directional Tourism) and is in addition to any deposits charged by the tour operator/airline or other travel supplier.

The reservation deposit is non-refundable but if you proceed with the booking the amount of the reservation deposit will be credited against the final amount payable. Upon cancellation, the reservation deposit is forfeited.

If any deposit is not received in full by the due date, reservations may be cancelled without further notice.

In many cases, cancellation costs may be claimed against your insurance policy, and accordingly, travel insurance is strongly recommended. Please ask your Consultant for details of our NIB travel insurance policies which can be purchased as part of your travel package. Travel insurance provides cover when the premium is paid and the policy issued, and so should be taken out as soon as any deposit or payment is made for maximum protection.

4. Payment Conditions

INDEPENDENT TRAVEL & SELF-DRIVE: except as otherwise specified in these Terms. The balance of the Price of your booking shall become due and payable no less than 45 days prior to your travel departure date unless otherwise advised at booking confirmation.

GROUP TOURS, SPECIALIST ACTIVITIES & SPECIAL EVENTS: the balance of the price of your booking shall become due and payable at least 60 days prior to your travel departure date or as advised at booking confirmation.

Late bookings: Where possible, we will accept late bookings within 15 days of departure, but please understand that this will be subject to the availability of accommodation, tours and flights. Full payment is required at time of requesting the booking if you book within 15 days of departure.

Special payment conditions may apply to selected products. These conditions will be listed on your booking confirmation.

All airfares are subject to strict payment and ticketing deadlines, to be advised at the time of requesting the booking

ALL PRICES ARE SUBJECT TO CHANGE PRIOR TO FINAL PAYMENT.

5. Cheque and Electronic Payments

Personal, bank, company cheques and electronic payments are accepted however may take 3-10 working days to clear. Should a payment be provided without the relevant clearance period, penalties may apply.

6. Credit Card Payment

Little Bird Travel reserves the right to charge administration/service fees for any payments made by credit card. These charges are up to 3%. Please ask your Consultant for further details

7. Payments to Travel Agents & Third Parties

Any payments made to a travel agent or a third party will not be taken as payment to Little Bird Travel (Directional Tourism) until Little Bird Travel (Registered to Directional Tourism) receives such payments (in full). Little Bird Travel takes no responsibility, and shall have no liability in respect of, any failure by a travel agent or a third party to make payment of any amounts to Little Bird Travel by the relevant due date for payment.

8. Cancellations

If you cancel or terminate your travel booking with us at any time after confirmation, any deposits and subsequent payments will be deemed non-refundable. It is important to note that there may be additional cancellation fees charged by the hotel, tour operator, cruise line, airline or other principal. This can amount to up to 100% of your total booking, particularly when cancelling tours and other arrangements within 60 days of departure. No refund can be guaranteed for cancellations after the tour has commenced or in respect of any tours, accommodation, meals or any other services not utilised. Local operators are not authorised to offer refunds on behalf of Little Bird Travel (Registered to Directional Tourism) under any circumstances.

Having accepted your booking, should it become necessary for you to cancel your reservation after booking confirmation and 60 days or more prior to departure date, any deposits paid will deemed non-refundable.

Cancellations made within 60 days of departure date will incur the following charges expressed as a percentage of the confirmed tour or package price:

59-30 days prior to departure                      20%

29-11 days prior to departure                       50%

10 days or less prior to departure               100%

Any land arrangements subject to special conditions and penalties in respect of deposits, cancellation or amendments will be advised at time of booking

Airfares are subject to special fare conditions and penalties will apply for cancellation or amendments as advised at time of booking

 

9. Amendments

In respect of any amendments to your booking after payment of a deposit and in addition to fees charged by airlines, wholesalers and operators Little Bird Travel (Registered to Directional Tourism) reserves the right to collect the following fees:

Domestic booking                            $35 per person

International booking                       $50 per person

Airfares: Tickets are issued on your airfares on receipt of full payment. Once ticketed, these airfares are non-refundable as per airline conditions. Any amendments to these flights will incur a fee.

Little Bird Travel (Registered to Directional Tourism) cannot be held responsible for airfare conditions when the airfare is purchased via the internet or a third party. All such risk, loss and expense must be borne by the client.

10. Additional Fees & Surcharges

Any Price quoted by Little Bird Travel (Registered to Directional Tourism) may be subject to surcharges for increases in costs such as fuel, credit card fees, Government action or adverse currency fluctuations.

Fees for quotes: Little Bird Travel (Registered to Directional Tourism) may, at its sole discretion, charge a fee of AU$50 to provide a quotation for travel arrangements.  This fee will be non-refundable but any amount paid will reduce the final balance of payment accordingly.

Late payment: Little Bird Travel (Registered to Directional Tourism) may, at its sole discretion, charge an additional fee of AU$50 with respect to any late payment of any money payable by you to Little Bird Travel (Registered to Directional Tourism) to cover additional processing costs incurred by Little Bird Travel (Registered to Directional Tourism).

Late booking: Little Bird Travel (Registered to Directional Tourism) may, at its sole discretion, charge an additional fee of AU$50 on any booking made within 15 days of your travel departure date to cover additional processing costs incurred by Little Bird Travel (Registered to Directional Tourism).

Document reissue: A fee of AU$50 per person will apply to any reissue and dispatch of travel documents by or on behalf of Little Bird Travel (Registered to Directional Tourism) to you (or any other person covered by your booking).

Where bookings relate to a period in which special events including but not restricted to public holidays are due to take place, bookings may be subject to surcharges, as well as additional or varied terms and conditions (including with respect to cancellation policies, deposit requirements, payment and surcharges), as advised by Little Bird Travel (Registered to Directional Tourism).

Insurance Claim Documentation Support Fee: May be charged for any information necessary including for insurance purposes, if/when insurance is not taken with Little Bird Travel (Registered to Directional Tourism).

Ticketing fees for other services may apply. Please ask your Consultant for further details. These fees are in addition to any fees charged by airlines, wholesalers and operators.

No surcharges shall be added to the Price of your tour or other travel arrangements after the date on which final payment has been made in full by you in relation to your booking.​

11. Group Tours, Specialist Activities & Special Events

Bookings may be subject to additional or varied terms and conditions (including with respect to cancellation policies, deposit requirements, payment and surcharges), as advised at time of booking confirmation.

12. Inclusions and Exclusions

You are responsible for payment of anything not specifically included in your holiday package, these include but are not limited to:

  • Airfares and associated taxes and fuel surcharges (unless otherwise stated)

  • Costs of passports or visas

  • Meals other than those specified in the itinerary

  • Sightseeing other than specified in the itinerary

  • Excess baggage charges

  • Personal items such as phone calls, laundry, drinks, room service etc

  • Airport taxes (paid locally) and Government taxes other than on accommodation

  • Gratuities unless otherwise stated

  • Travel Insurance.

13. Clients Responsibility

You undertake to acknowledge and accept responsibility with regards to the following

  • All coupons, receipts and tickets are issued subject to the terms and conditions specified by the suppliers.

  • By accepting the coupons, tickets and utilising our services, you agree that, apart from certain rights you have under the Trade Practises Act that we cannot alter, neither Little Bird Travel (Registered to Directional Tourism) nor any subsidiary company or representative shall be liable for any loss, injury or damage to you or your belongings or otherwise arising in any way out of our services to you.

  • Your Consultant can advise you on passport and visa requirements, but it is your responsibility to ensure you comply with these regulations before travelling.

  • The supplier and airline refund process can consist of months of investigation; Little Bird Travel (Registered to Directional Tourism) will assist this process however does not take any responsibility for the length of time taken by them.

 

14. Special Requests

All special room requests & dietary requirements must be advised to Little Bird Travel (Registered to Directional Tourism) in writing when the booking is requested. Special requests will be advised to tour operator/airline or other travel supplier but cannot be guaranteed.

Room configurations are provided as a guide only and may change, subject to room availability, renovations or other circumstances. Prices as quoted are based on existing bedding applicable to the relevant room type as cited. Additional bedding may be either a bed or a fold up ‘rollaway’ or a convertible settee. Room requests (eg interconnecting, twin versus double bedding, non-smoking rooms etc) can be requested, but cannot be guaranteed

 

15. Authority

If an accident, disaster or emergency is reported to have occurred in a country where I/we will or may be travelling. I/we authorise you to disclose to the Australian Government Department of Foreign Affairs and Trade details of my/our itinerary (including without limitation, transport and accommodation arrangements) and my/our contact details within Australia and overseas.

16. Health, Passport & Visa Requirements

You are responsible for all visa, passport, immigration, quarantine, customs, health and other requirements of the countries visited or transited. Passports must have at least 6 months’ validity from the date of your return to Australia. The Australian Government has many travel advisories in place, for the latest details refer to www.smartraveller.gov.au  

If you are not sure of your responsibilities, ask your travel consultant.

Travellers to USA: All Australian passport holders travelling on the visa waiver program are required to obtain an electronic travel authorisation prior to boarding an aircraft or ship to the USA. Refer to the ESTA (Electronic System for Travel Authorisation) website; https://esta.cbp.dhs.gov

Travellers to Canada: It is compulsory for all Australian passport holders travelling to Canada to obtain an electronic travel authorisation prior to boarding an aircraft or ship to Canada. This can be obtained online on the official ETA website;

For both USA and Canada applications should be submitted no less than 72 hours prior to travel. Please note it is the responsibility of the client to apply for this authorisation.

Travellers to the USA and Canada who have been convicted of drink driving charges and/or hold any other convictions are advised to apply for their visa and not use the visa waiver programme.

Please note these VISA/Entry Permit authorisations are subject to change at any time and should be used as a guide only.

 

 

17. Travel Insurance

Little Bird Travel (Registered to Directional Tourism) strongly recommends that you purchase travel insurance Please ask your Consultant for details of our QBE travel insurance policies which can be purchased as part of your travel package. Travel insurance provides cover when the premium is paid and the policy issued, and so should be taken out as soon as any deposit or payment is made for maximum protection.

Travel insurance should cover hospital treatment, medical evacuation, loss of property, cancellation fees etc and is deemed essential for anyone travelling outside of Australia. Overseas medical costs are expensive and not covered by Australian medical insurance.

18. Consumer Protection Legislation

Nothing in these Terms will operate to exclude, restrict or modify the application of any of the provisions of the Trade Practices Act 1974 (Commonwealth) or any equivalent State or Territory legislation in Australia, the exercise of a right conferred by such a provision, or any liability of Little Bird Travel (Registered to Directional Tourism) for breach of a condition or warranty implied by such a provision, where it is unlawful to do so.

 

 

19. Liability

We, Directional Tourism Pty Ltd trading as Little Bird Travel (Registered to Directional Tourism) (ABN 33 607 879 032), have packaged and presented tours, transfers and accommodation for sale in Australia. In our opinion, we have provided information and pricing which is correct at the time of issue and also goods and services of merchantable quality. Force Majeure: Little Bird Travel (Registered to Directional Tourism) shall not be liable for any delay or for any failure to fulfil its obligations under these Terms (or any service obligations to you) if the failure or delay arises directly or indirectly from or as a consequence of any Force Majeure Event.

 

20. Complaints

Any problems that occur whilst on a tour or other travel arrangement must be submitted in writing to The Manager at Little Bird Travel (Registered to Directional Tourism) at the earliest opportunity, and in no event later than 30 days after returning from such tour or other travel arrangement. Failure to comply with this complaints procedure shall result in forfeiture by you of any potential claim against Little Bird Travel (Registered to Directional Tourism) with respect to such complaint.

 

 

21. Law and Jurisdiction

These Booking Conditions are governed by the laws of South Australia and any action arising under them, or in any way connected with the travel arrangements, may be brought only in a court in South Australia, subject to any law which is expressly inconsistent with this.

 

22. General

These Terms may be subject to amendment by Little Bird Travel (Registered to Directional Tourism) from time to time. 

Any information presented by Little Bird Travel (Registered to Directional Tourism) is to the best of our knowledge correct at the time of publication. However, changes beyond our control may occur after publication with respect to prices, standard of services, tour duration and content. Every effort is made to ensure accuracy however Little Bird Travel (Registered to Directional Tourism) cannot be held responsible for printing or typographical errors, or errors arising from unforeseen circumstances.

Additional terms and conditions may apply to your booking and will be advised by your Little Bird Travel (Registered to Directional Tourism) representative at the time of booking (or variation thereof).

All prices specified in any brochure or online are gross amounts.

 

 

23. Illustrations

All photographs in any brochure produced by Little Bird Travel (Registered to Directional Tourism) illustrate genuine events and places. Their use or particular positioning should not be interpreted as confirmation that those events and places will necessarily be seen on the relevant tour. Any questions in this regard should be directed in writing to The Manager prior to the finalisation of travel arrangements.

 

 

24. Definitions

All references to tours and travel refer to any Hosted/Guided or Independent Self-drive arrangements in these booking conditions

Force Majeure Event means any act of God, war, terrorism, fire, flood or any other extreme weather conditions, loss of power, epidemics or pandemics, industrial disputes, slow-downs or other strike activities, riots or civil disturbances, acts of government, semi government or other authorities, inability to obtain any necessary licence or consent and delays caused by sub-contractors, suppliers or other third parties (including telecommunications carriers), material shortages or other disruption to any tour or other travel arrangements.

GST means as applicable, any goods and services or value added tax in terms of A New Tax System (Goods and Services Tax) Act 1999 (Commonwealth of Australia), at the rate prevailing from time to time and includes any reassessment thereof.

Price means the price quoted by Little Bird Travel (Registered to Directional Tourism) for any tour or other travel arrangement in the relevant booking confirmation (or amendment thereof).

Terms means these terms and conditions and, for the avoidance of doubt, includes any additional terms and conditions relating to your booking as advised by your booking agent at the time of booking.

Travel departure date means, in respect of any tour or other travel arrangement, the first date in which pre-booked arrangements made by Little Bird Travel (Registered to Directional Tourism) commence.

Group Tours means privately hosted/guided tours generally consisting of 10 or more passengers.

Independent Travel / Self-Drive means any travel plans (not defined as a “tour”) in respect of which Little Bird Travel (Registered to Directional Tourism) have provided services (for example, any independent holiday or vehicle hire).
